  1. Start your search with the Grantor/Grantee index.
  2. Identify the current owner (Grantee) and prior owner (Grantor) of the subject property
  3. Identify the book and page number, or document number of the deed
  4. Print the first page of the deed.
  5. This current deed will also provide you the name of the prior owner (Grantor). Then run a search on the Grantor and find the deed that transferred ownership of the subject property to the Grantor.
  6. Print the first page of this deed.
  7. Repeat: Then use the index to keep tracing the transfer of ownership of the subject property until you obtain (4) deeds (first page only.)

Hypothetical – It is discovered that there is a defect in the current deed in that the real property included in the legal description of the deed does not reflect the true ownership of the property parcel. However, this deed error goes back (4) transactions. Essentially, (4) transfers prior there was an error in the deed as to the legal description of the property which included property that wasn’t owned by the Grantor. This mistaken legal description of the real property continued forward to the current deed as each subsequent transaction just copied the property description from the prior deed. Thus, (4) prior Grantor’s signed the prior deeds in error. However, each prior Grantor gave only certain warranties to each Grantee when signing each deed depending on the type of deed.
  2. You represent the current owner of the subject property. There clearly has been a breach of warranty in that deed description of the property doesn’t coincide with actual ownership. Who do you take legal action against? What is the basis for your legal action? If you successfully take legal action a prior owner, will they be able to turn around and take legal action against another prior owner?
