EXERCISE

Lawyers note up’ important cases to prepare to represent their clients. Human Resource Managers need to be able to support their advice with reference to previously decided cases. And students in my class need to be able to support their answers with reference to case and statute law. You need to be able to summarize and refer to the many cases referred to in this course in order to do well. I have given you a Case Digest form which you can use or another system of your own devising is fine. But do this as you go through the readings – not just the night before a test.

In Class 2, under Relevant Cases, I have given you the hot-link to the Egan v Alcatel OCA decision on CANLII, although you can also go to the CANLII site and search it up by name (as you can any other reported case). Read the decision. Prepare a case summary similar to those found in the boxes in the text e.g. Box 6.2 Queen v Cognos. Include a brief summary of (1) the key facts; (2) the main issue the court was to decide; and (3) the court’s decision and the remedy (if any) ordered. Keep it concise and to 3 or 4 short paragraphs.
