1. You are about to conduct negotiations with a firm from another country. How does your degree of familiarity with the other country’s culture effect how you are going to conduct these negotiations? What factors help or hinder international negotiations?
2. You work for a company that has had a lot of consumer complaints about defective products. You know that your defect rate is close to the industry average. You also know that many of the customers who complain about defects have caused the damage themselves because of improper use. In handling complaints, you have replaced the product when you believe it was defective. When you believe the customer has damaged the product, you do not replace it. Very few customers have taken you to small claims court in the past, but you have only lost one case. A friend has suggested that you institute a med-arb system to handle these complaints. Evaluate this suggestion.
3. Critics of arbitration who are concerned because even “bad” decisions are “final and binding” have suggested that the courts adopt a policy of reviewing arbitration cases, when asked by one of the parties to do so, to determine whether or not the decision of the arbitrator was “clearly erroneous”. Evaluate the suggestion.
4. What are the advantages and disadvantages of coalitions in negotiation? When do you need a coalition and how do you make it more effective?
