1)Ethical issues in courts seem to be a ongoing problem with our system. One part I believe is the prosecutors. They are the one’s that represent their clients and help convict the defense team. Prosecutors can be bias when it comes to cases. Their reputation is on the line. One example can be when the defendant does not take the plea bargin and the prosecutor acts in a retaliation manner during trial. They may also intentionally attempt to compromise the jury selection by seeking out who is partial and bias in their favor.
2)An ethical issue with in the the criminal justice system related to courts or court procedures could be a judge using his power to over sentence people. With minimum and maximum sentencing guidelines there is a scale or range of time that people can be sentenced to. I have seen and heard of judges in my local jurisdiction using personal reasons or feelings for sentencing those that break the law. For instance if a judge has lost someone close to them to a drunk driver or even know or knew someone who drives drunk they may try to set an example out of those that come before them. I don’t necessarily see it as an ethical issue but I have spoken to some people and they feel it is. Same thing with pedophiles and rapists and anyone that takes advantage of the elderly and children. If a judge decided to say screw it life in prison for your first offense of sexual battery or rape, etc I don’t see an issue with it but some others may. I guess what I am saying is there is a lot discretion in the courts no matter what the crime is. Bribes are also an ethical issue. I don’t know of any cases personally but I do know that it happens. Someone pays a judge, prosecutor or police officer to aid in dropping a case or charges or lose evidence.
