Directions: In this discussion forum, you will evaluate in which situations the FCC has the jurisdiction to regulate and, if appropriate, levy fines or other punishments for indecency:
- A pop star is performing in the Super Bowl’s half-time show, which is being broadcast live on TV. Whether purposely or not, she suddenly has a wardrobe malfunction, exposing full breast for a moment. Does the FCC have the authority to punish (aka regulate) anyone on behalf of this? If so, would it be the pop star, the Super Bowl franchise, or the TV network?
- A film contains gratuitous uses of the words “fuck” and “shit,” along with several sex scenes during which full frontal female nudity is displayed. Does the FCC have the authority to punish (aka regulate) anyone on behalf of this? If so, who?
- A newspaper editorial contains the word “fuck” six times. Does the FCC have the authority to punish (aka regulate) anyone on behalf of this? If so, who?
- During a radio segment, a woman describes in detail why she likes porn star Ron Jeremy, concentrating the discussion on his anatomy and ultimately using several swear words in the conversation, including the f-bomb and other swear words. Does the FCC have the authority to punish (aka regulate) anyone on behalf of this? If so, who?
