Understanding and respecting the rule of law in the context of administrative agencies is paramount given that many agencies make law through its rulemaking process. For agencies to accomplish their statutory missions they must have this rulemaking flexibility, which is needed to address novel and emergent events that require both speed and efficiency. However, reviewing courts have traditionally afforded agencies considerable deference in this area, so long as they do not stray too far from their statutory mandates, and administrators have not acted in an arbitrary and capricious manner. Still, the process of judicial review is both challenging and problematic for both agencies and the reviewing courts.
