This week’s readings talk about an important issue with regards to social control: legitimacy. In order for the police and the courts to establish and maintain social order, people must believe they are legitimate. The research shows clearly that people do not comply with laws and legal actors like the police if they do not view them as legitimate. But what factors determine whether or not the police and the courts are viewed as legitimate authorities? That’s what this week covers! Here are this week’s questions:
- In the Tyler (2014) article, “How Do the Courts Create Popular Legitimacy”, what were the findings with regards to the factors that influence popular legitimacy of courts?
- In the same article, describe the four components of procedural justice that were measured. How does Tyler argue that these components influence whether people believe legal actors are implementing procedures fairly?
- In the Tyler, Callahan and Frost (2007) article, which factors were found to predict whether agents of social control adhered to rules (both compliant and deferential adherence)? Describe these factors in detail.
- In the Tyler (2004) article, “Enhancing Police Legitimacy“, describe the argument the author makes in regards to police being viewed as legitimate. In other words, what causes the police to be viewed as legitimate? What are the benefits of the police being viewed as legitimate?
