We will spend some time on each of these fundamental freedoms that are treasured, and yet not always honored. Continuing from last week, we delve into the very complex, yet to most of us, fundamental freedoms of speech, assembly and association, which can be summarized as those that relate to John Stuart Mill’s “harm” principle and the rather more pedestrian, but no less important one of “location” and “the “form of expression.”
This questions seems to be difficult, but consider it in very literal terms and answer it in your own terms. If you can refer to the readings wonderful. But mos important, consider the question on the basis of your existing knowledge of how the Supreme Court works, or does not work.
1. Why has the Court been more willing to restrict freedom of expression in certain times and has allowed more liberal standards at other times?
