PROJECT 3 – Statutory Analysis Memo ( 10 %)

Purpose

The purpose of this project is to develop skills analyzing facts, a legal issue, and a statute, applying the statutory law, and explaining the analysis in a legal memorandum.

Course Outcome Met by Project 3:

Background: Attorney Chong has asked you to draft a statutory analysis memo related to the Hastings case.

The Project 3 statutory analysis memo will analyze case facts and statutory law.

Facts: Please refer to the HASTINGS CASE FACTS: Projects 1,2,3,4 in Content to review the facts and court opinions relevant to Mary Hastings’ case.

NOTE: Review the facts in the Hastings case, but – for this project only – ASSUME A CHANGE IN FACTS IN THE HASTINGS INCIDENT.

This change in facts in the Hastings case include:

Substitute 2 different dates into the incident facts:

  • assume Hastings had her slip and fall incident on January 2, 2017,
  • assume Hastings did not seek legal advice from Chong & Associates until June 5, 2020.

ALL OTHER FACTS WILL REMAIN THE SAME FOR THIS PROJECT.

Using the facts in HASTINGS CASE FACTS: Projects 1,2,3,4 – EXCEPT THE SUBSTITUTED 2 NEW FACTS LISTED ABOVE:

Draft the statutory analysis memo using the IRAC format. The memo must follow the IRAC format and include four sections: Issue, Rule, Analysis and Conclusion.

Review a sample IRAC memo in Week 4 Instructor Notes.

The memo analysis must address the issue and apply the statute below.

ISSUE:

Whether, under Maryland law, Mary Hastings is time barred from pursuing her complaint against Gilford Pines Condominium Association by the Maryland statute of limitations?

Statutory Law:

Maryland Courts and Judicial Proceedings Section 5-101

Comprehensively, analyze the facts, issue, and apply the statutory law. Substantively explain your analysis and support your conclusions.
