On 1′ Sept 2021, Sadig entered into a contract with Omar for the latter to sell “all the bags
of flour he has in his warchouse”, to the former. The parties agreed that Sadig should collect
the goods by 10’* Sept, as Omar needs to use the space. On 5’* Sept 2021, Sadiq resold 100
bags of flour to Bakr and gave him a delivery order to collect the goods from the warchouse.
When Bakr arrived, the 100 bags were already set aside and ready for collection. Bakr showed
the delivery order to Omar who instructed his workers to start lading the bags of flour onto
the lorry, Unfortunately, before loading could even commence, there was a short circuit and
the warehouse suddenly caught fire. It spread so quickly destroying everything in the
warehouse, including the flour.
Sadig is now suing Bakr, who is refusing to pay for the price. Discuss the rights and liabilities
of the parties involved.
