You are the legal training officer for your state’s corrections agency and have been asked by the state Secretary of Corrections to train employees on the implications of this case. Specifically, the Secretary wants you to address the Eighth Amendment’s Cruel and Unusual Punishment Clause’s historical impact on the state’s current and anticipated ability to use the death penalty to punish the crime of child rape.
