I would agree supervisors should perform the duties assigned to them effectively, truthfully and free of bias. Unfortunately like Lominy, my experience has shown many supervisors contemplate unethical behaviors on behalf of relationship status’s.

I am currently confused regarding Oliverio’ case though, are you implying he has grounds under the IRCA to file claim? Please don’t take this negatively and do correct me if I am wrong but doesn’t that act only apply to those of immigrant status’s? Being that American was added to Oliverio’s demographic profile it leads me to believe he’s a citizen and that he was discriminated because of his ancestry origin not because of his birth place. Oliverio could claim national origin harassment being that his work environment was severe and hostile, since his supervisor reacted in the same negative manner as his fellow co-workers and didn’t rectify the situation. Wouldn’t he have a better chance at that point to file claim under Title VII?

Here is what the other tutor posted for me and she responded to this and now I need  a responseChapter 7 Oliverio Case Study (Scenario 2)            In the case study, Oliverio is discriminated against by both his colleagues and the manager. He gets fired on the basis that he mistakenly threw the manager’s soda bottle. As per legality, this action does not equate him to get fired. In fact, the employment relationship Act stipulates that the employees have rights that govern how their supervisors treat them. In the case study, Oliverio faced racial discrimination. From experience reading law books and what I have learned from this class, evident In Sec. 274A of IMMIGRATION REFORM AND CONTROL ACT OF 1986, it states that when a person is treated unfairly on the grounds of ethnicity, the person should report the matter, and the court of law will subject legal actions (Bennett-Alexander, 1998). In my opinion, the case portrays direct discrimination, whereby Oliverio was discriminated against since he was Mexican American, unlike his other colleagues. Because it is prohibited to discriminate against others based on race in the workplace, Oliverio should pursue legal action, as the manager wrongfully and unethically dismissed him from his job duties. Oliverio can stand up for his rights by making an employment tribunal complaint in court. As a result, the court will alleviate the situation and determine the appropriate legal action.
