Generally, there has been only a modest concentrated effort to explore the real commercial options for a BTI patent. The group frequently hires consultants to help identify product areas that could utilize the IP and particular companies to target as potential licensees. This is where you come into the picture!
You are working as a commercialization analyst and consultant for BTI. Your 6-page document will be a report and recommendation to BTI. Your analysis goal is to identify winning commercial trajectories for your client’s IP.
a) Main points of differentiation and value of this IP, relative to competitive technology (prior art cited in patent and other discoveries you make).
b) Market and product areas that could incorporate the IP, along with rough estimates of market size, initial sense of whether this will be incorporated into a B2B, B2C, B2G type of product.
c) Potential of this IP as basis for starting a new company. You may choose to cite the “Gans / Stern Framework” as guiding your recommendation on this point.
