Two African American plaintiffs sued the producers of the reality TV series The Bachelor and The Bachelorette for racial discrimination. The plaintiffs claimed that the shows had never featured a person of color in the lead role. Plaintiffs also alleged that the producers had failed to provide people of color who auditioned for lead roles with the same opportunities to compete as White people who auditioned. 1) Based on the facts alleged, can the plaintiffs establish a prima facie case for disparate treatment discrimination? Why or why not?
2) Next, now assume that the plaintiffs can establish a prima facie case and the burden of proof has shifted to the employer. What might be the employer’s “legitimate nondiscriminatory reason/ legal reason” for not hiring the plaintiffs?
