I’m working on a writing multi-part question and need an explanation to help me learn.

Directions for drafting the Memorandum to the Attorney:

You may use any one of the hypothetical “client” cases :

You are a social worker, employed by a law office. Applying what you have learned through the assigned readings, write a memo to Linda Lawyer who also works in your office and is the attorney assigned to represent your shared client within his/her legal matters.

Draft a memorandum to Linda Lawyer that will be used to prep for the upcoming hearings and the eventual trial. Present a summary of the relevant facts; look at what crimes (criminal case) or violations (civil case) your client could face as well as any defenses. Address the client’s strengths and weaknesses and what social services or other supports you can put in place to help the client to stabilize as well as any long-term stabilization plan. Be specific about the what records you want to subpoena or what evaluations should be arranged, how you think they will be helpful, and indicate what, if any, releases and authorizations may need to be signed by the client.

If you see an ethical conflict in the fact pattern, be sure to identify it and propose how it should be resolved.

Here is a template for your memo:

To: Linda Lawyer, Esq.

From: (your name)

Date:

RE: (client name)

Summary of the Facts:

Legal Challenges for the Client (possible charges and defenses):

Client Strengths and Weakness:

Preparation for moving forward (what records needed, evaluations that need to be performed, witnesses needed)

Social services, supports (including legal action you can take on client’s behalf) that will assist client in stabilizing:

Other Considerations (miscellaneous matters, ethical issues you want to bring to Attorney’s attention)
