Sean and Jacqueline have one daughter from their marriage, Lisa. After five years of marriage, Jacqueline left Sean to reside with her new partner, Maryann. Jacqueline and Maryann are planning to marry since the New York Legislature legalized such a marriage. At the divorce hearing, Sean and Jacqueline both asked for residential custody of their daughter, Lisa. Sean owns a major real estate construction company and sometimes has to travel to his various work sites. He generally travels 2 hours back and forth to work. His parents have offered to help Sean raise Lisa. Sean believes that he should have sole residential custody and it would not be in Lisa’s best interest to reside in Jacqueline’s home. Jacquline’s parents are also seeking residential custody asserting that their home and their lifestyle would be more appropriate to raise a young lady.
What is the issue? The decision for the case? The reasoning for the decision? What factors would be relevant in determining who should be awarded custody? What arguments will each of the parties make in favor of their position (can make up situations and evidence to support each side) What options would you consider in your decision?
Using cases like Supreme Court of Virginia V. Jane Doe, John Doe and Ann Smith Doe (1981), Shawn L. McGRIFF, Plaintiff-Respondent, v. Theron W. McGRIFF, Defendant-Appellant (2004), and Domestic Relation Laws (for the grandparents), how can we apply these cases to the case brief decision?
