CASE STUDY
Here is a case to think about and respond to and then I will give you the court finding.
CASE: Mr and Mrs G sue their physician. Mr G Suffered a TIA (sudden loss of neurologic function due to vascular impairment to the brain). His current symptoms included garbled speech, the loss of ability to express himself via speech, writing or signing; and/or the ability of comprehending spoken or written word. He had a past history of several of these so the cardiologist Dr R determined he needed a cerebral angiogram to find the exact location of the blood clot. Dr R had Mr G sign a consent form. During the procedure Mr G suffered a stroke which permanently disabled him. A suit was filed by Mr and Mrs G saying the procedure was done without informed consent.
In summary, the facts of the case are: *Married gentleman *Past medical history of TIA’s *Admission symptoms where those listed (loss of ability to express himself in speech and writing, and loss of ability to understand written and spoken word) *MD decides to perform a cerebral angiogram to locate clot *Mr G Signed a consent prior to procedure *Mr G suffered permanent disability as result of stroke suffered during procedure Mr and Mrs G sued md saying he failed to get informed consent.
